1. Limited Warranty
1.1 Coverage
Ladder Genie Inc. (“Ladder Genie”, “we”, “our”, or “us”) warrants the Ladder Genie hoisting system and its original components (the “Product”) to be free from defects in materials and workmanship under normal, intended use and when installed, operated, and maintained in accordance with the Product Manual and safety instructions.
This Limited Warranty applies only to new, original Ladder Genie products purchased directly from Ladder Genie or an authorized dealer, by the original purchaser.
1.2 Warranty Period
- The warranty period is 12 months from the original date of purchase, as shown on the customer’s sales receipt or invoice from Ladder Genie or an authorized dealer.
- Any repair, replacement part, or replacement Product provided under this Limited Warranty does not extend, renew, or restart the original warranty period.
1.3 Ladder Genie’s Obligations
If a valid warranty claim is approved within the warranty period, Ladder Genie will, at its sole discretion:
- Repair the Product; or
- Replace defective components with new or refurbished parts; or
- Replace the Product with an equivalent unit.
These remedies are the sole and exclusive remedies available under this Limited Warranty.
1.4 Exclusions (What Is Not Covered)
This Limited Warranty does not cover, and will be void if damage results from, any of the following:
- Normal wear and consumable parts, including but not limited to:
- Hoist cable
- Trolley sliders
- Sheaves, pulleys, bearings, or spacers
- Power cords
- Remote controls and batteries
- Misuse, abuse, improper setup, improper storage, neglect, or failure to follow the Product Manual and safety instructions.
- Use of the Product for any purpose other than lifting roofing shingles and approved roofing accessories (for example, lifting people, animals, liquids, or unsecured loads).
- Use of non‑approved accessories, or any modification or alteration of the Product.
- Use with ladders that are incompatible with, or below the minimum ladder capacity specified in, the Product Manual.
- Improper loading, overloading, accidents, drops, impact, overuse, exposure to water or chemicals, or operation in unsafe conditions (including but not limited to high winds, severe weather, or unstable or uneven surfaces).
- Electrical damage caused by incorrect power supply, improper extension‑cord selection or use, or failure to follow electrical instructions in the Product Manual.
- Any repair, attempted repair, disassembly, or tampering with the hoist motor, controls, or electrical components by anyone other than Ladder Genie or its authorized personnel.
Cosmetic damage (for example, scratches, dents, or discoloration that do not affect function) is not covered.
1.5 Customer Responsibilities
To maintain warranty coverage, the customer must:
- Install, use, and maintain the Product strictly in accordance with the Product Manual and all safety warnings.
- Perform regular inspections and maintenance, including timely replacement of worn parts with Ladder Genie–approved replacement parts.
- Immediately stop using the Product if any damage, excessive wear, or unsafe condition is observed and contact Ladder Genie for guidance.
Failure to meet these responsibilities may result in denial of warranty coverage.
2. Warranty Claim Process
Because Ladder Genie does not operate physical service centers, all warranty claims must begin by email.
2.1 How to Submit a Claim
- Email: support@laddergenie.ca.
- Include:
- Full name and company name (if applicable)
- Contact details
- Proof of purchase (receipt or invoice)
- Product serial number (if available)
- Clear description of the issue, how and when it occurs
- Photos and/or short videos showing the problem and overall installation
- Ladder Genie will review the information and may request additional details, further photos/videos, or inspection steps to assist diagnosis.
2.2 Service Method and Lead Times
- If a warranty claim is approved, Ladder Genie will determine the most appropriate solution: repair, replacement part, or Product replacement.
- Ladder Genie is a startup sourcing components and products internationally. Although extra parts are stocked, replacement parts and/or units may require up to six (6) months lead time, depending on availability and manufacturing schedules.
- Unless otherwise required by law or specifically agreed by Ladder Genie, customers are responsible for:
- Uninstalling and re‑installing the Product or components, following the Product Manual and any additional instructions provided; and
- Shipping costs to return any Product or component to Ladder Genie or to an authorized location.
3. Orders and Payment
- All prices are listed in CAD, and are subject to applicable taxes, duties, and shipping fees.
- Orders are not considered final until payment is successfully processed.
- Ladder Genie reserves the right to refuse or cancel any order at its discretion, including after order placement but before shipment, with any payment refunded if the order is not fulfilled.
4. Disclaimers and Limitation of Liability
To the maximum extent permitted by applicable law:
4.1 Exclusive Warranty
- This Limited Warranty is the only express warranty made by Ladder Genie with respect to the Product and is in lieu of all other warranties or conditions, express or implied, including any implied warranties or conditions of merchantability, fitness for a particular purpose, durability, or non‑infringement.
- Some jurisdictions do not allow limitations on implied warranties or conditions; in such cases, the above limitations apply only to the extent permitted by law.
4.2 Limitation of Liability
- Ladder Genie’s total aggregate liability for any and all claims arising out of or related to the Product, its use, or this policy (whether in contract, tort, negligence, strict liability, or otherwise) is limited to, at Ladder Genie’s option:
- the repair or replacement of the Product, or
- the amount actually paid by the customer for the Product.
- Ladder Genie is not liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to lost profits, loss of use, business interruption, or damage to other property or equipment, even if advised of the possibility of such damages.
4.3 No Safety Guarantee
- The Product is designed as a material‑handling tool and must be used only as described in the Product Manual and safety instructions.
- Ladder Genie does not guarantee that use of the Product will prevent accidents, injury, or property damage. Users remain responsible for safe job‑site practices and compliance with all applicable laws, codes, and safety regulations.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply in all cases. In those jurisdictions, Ladder Genie’s liability will be limited to the fullest extent permitted by law.
